Terms of Use
These Terms of Use ("TOU") posted on the Possibilities Project Plus website ( “Possibilities Project Plus”) set out the terms on which St. Joseph’s Health Care London, the operators of Possibilities Project Plus (the “Operators”) offer you access to and use Possibilities Project Plus services (“Services”). By using or accessing Possibilities Project Plus you agree to comply with these TOU. If you do not agree to the TOU you must cease use of Possibilities Project Plus. If you are dissatisfied with these terms or Possibilities Project Plus, your sole and unique recourse and remedy is to discontinue using and accessing Possibilities Project Plus. The Operators may modify the TOU at any time in at sole discretion. You are responsible for periodically checking for changes to and agree to be bound by any revised TOU if you continue to use Possibilities Project Plus. Our Privacy Policy, Prohibited Content list, and all other policies, site rules, and agreements referenced below or on Possibilities Project Plus, are fully incorporated into this TOU, and you agree to them as well.

License
If you agree to the TOU and (1) are eighteen (18) years of age or older and have the capacity to use Possibilities Project Plus and be bound by the TOU, or (2) use Possibilities Project Plus on behalf of a business, thereby binding that business to the TOU, we grant you a limited, revocable, non-exclusive, non-assignable license to use Possibilities Project Plus in compliance with the TOU; unlicensed use is unauthorized. You agree not to display, "frame," make derivative works, distribute, license, or sell, content from Possibilities Project Plus, excluding listings you create on Possibilities Project Plus. You grant us a perpetual, irrevocable, unlimited, worldwide, fully paid/sublicensable license to use, copy, display, distribute, and make derivative works from content you post Possibilities Project Plus.

Acceptable Use
In order to access and use some or a portion of the Services, you are required to register and set up an account with your email address and a password (your “Account”). The email address you provide will be your email address, and you are solely responsible for maintaining the confidentiality of your password. You are solely responsible for all activities that occur under your Account. Therefore, you should protect your password and make your password difficult for others to guess. You may connect to the Services with a third-party service and you give us permission to access, store, and use your information from that service as permitted by that service and as may be described in our Privacy Policy. When using Possibilities Project Plus, you will post in the appropriate category or area. The following are examples of usage that are prohibited:

post content that is prohibited by any of Possibilities Project Plus's policies or rules referenced above ("Prohibited Content");

create listings/communications/accounts on behalf of a for-profit corporation for the purpose of soliciting business or selling commercial goods;

create false, misleading, unsolicited, and/or unlawful listings/communications/accounts;
-
distribute or contain spam, chain letters, or pyramid schemes;
-
infringe any third-party right;
-
distribute viruses or any other technologies that may harm Possibilities Project Plus or the interests or property of Possibilities Project Plus users;
-
impose an unreasonable load on our infrastructure or interfere with the proper working of the Possibilities Project Plus;
-
use or provide software (except general purpose web browsers and email clients) or services that interact or interoperate with Possibilities Project Plus, e.g. for downloading, uploading, creating/accessing/using an account, creating a listing, flagging, emailing, searching, or mobile use;

access/copy/collect Possibilities Project Plus content via use of any robot, spider, script, scraper, crawler, or automated or manual equivalent for any purpose without our express written permission;

copy, modify, distribute, harvest or otherwise collect any other person's content or user information without their consent;

buy or sell Possibilities Project Plus accounts;

abuse Possibilities Project Plus's flagging or reporting processes;

bypass measures used to prevent or restrict access to Possibilities Project Plus.
You agree that the Operators of Possibilities Project Plus may moderate the Possibilities Project Plus website access/use in our sole discretion, e.g., by blocking, filtering, re-categorizing, re-ranking, deleting, delaying, holding, omitting, verifying, or terminating your access/license/account. You further agree that: you will not bypass said moderation. The Operators of Possibilities Project Plus are not liable for acts or omissions relating to moderating or not moderating.

Disclaimer and Liability
To the full extent permitted by law, the Operators of Possibilities Project Plus (1) make no promises, warranties, or representations as to Possibilities Project Plus, including its completeness, accuracy, availability, timeliness, propriety, security or reliability; (2) provide Possibilities Project Plus on an "AS IS" and "AS AVAILABLE" basis and any risk of using Possibilities Project Plus is assumed by you; (3) disclaim all warranties, express or implied, including as to accuracy, merchantability, fitness for a particular purpose, and non-infringement; and (4) disclaim any liability or responsibility for acts, omissions, or conduct of you or any party in connection with Possibilities Project Plus. YOU ACKNOWLEDE AND AGREE THAT The Operators of Possibilities Project Plus are NOT liable for any direct, indirect, consequential, incidental, special, exemplary, punitive, or other losses, including for bodily injury or death, property damage, lost profits, revenues, data, goodwill, etc., arising out of or in connection with the use of the Possibilities Project Plus website, links with other websites or social media, the products acquired through the use of, or the transactions conducted on or from, the Possibilities Project Plus website or social media, even if Possibilities Project Plus Operators or its agents, contractors, have been previously advised of the possibility of such damages or claim.
Without limiting the foregoing, in no event will the Operators of Possibilities Project Plus be liable for ANY damages or losses due to misuse by other Possibilities Project Plus users, their respective employees, agents, mandataries or subcontractors, or other events beyond the reasonable control of Possibilities Project Plus, including but not limited to the following activities: (i) scams, mislabeled or incorrectly labelled products and/or equipment donated by users through the Possibilities Project Plus website; (ii) viruses including computer or web based viruses, data corruption, failed messages, damages arising as a result of same or transmission errors or problems, telecommunications service providers, Possibilities Project Plus’s Partners, the internet backbone, third-party suppliers of products or services, (iii) Possibilities Projects Plus acts or omissions relating to moderation or failure to moderate.
Indemnity

Your participation in and use of Possibilities Project Plus is entirely voluntary and provided only as a convenience. As a result, you agree to indemnify, defend and hold harmless the Operators of Possibilities Project Plus and its officers, directors, employees, agents, licensors, and their respective successors and assigns, from and against any and all claims, demands, liabilities, costs, or expenses whatsoever, including, without limitation, legal fees and disbursements, resulting directly or indirectly from your use, or use by your officers, directors, employees, agents, affiliates, or any other party, directly or indirectly, paid, directed or controlled by you, or acting for your benefit, of the Possibilities Project Plus website and/or Services.

Jurisdiction
These TOU and any claim, cause of action, demand, or dispute arising from or related to Possibilities Project Plus ("Claims") will be governed by the internal laws of Ontario, without regard to conflict of law provisions, except to the extent governed by Canadian federal law. Any Claims will be exclusively resolved by courts in London, Ontario (except that the Operators may seek preliminary or injunctive relief anywhere). You agree to (1) submit to the personal jurisdiction of courts in London, Ontario;.
Prohibited Content

All users of the Possibilities Project Plus must comply with all applicable laws, these TOU, and all posted site rulesof The list of goods, services, and content that you are prohibited from posting on Possibilities Project Plus includes but is not limited to the following:

recalled items; hazardous materials; body parts/fluids; unsanitized bedding/clothing

prescription drugs, medical devices; controlled substances and related items

alcohol or tobacco; unpackaged or adulterated food or cosmetics
-
false, misleading, deceptive, or fraudulent content; bait and switch; keyword spam
-
offensive, obscene, defamatory, threatening, or malicious listings or email
-
anyone’s personal, identifying, confidential or proprietary information
-
stolen property, property with serial number removed/altered, burglary tools, etc.
-
counterfeit, replica, or pirated items; tickets or gift cards that restrict transfer
-
spam; miscategorized, over-posted, cross-posted, or nonlocal content
-
listings or email posted by a for-profit corporation soliciting business or selling commercial goods
-
listings or email the primary purpose of which is to drive traffic to a website
-
listings or email offering, promoting, or linking to unsolicited products or services
-
affiliate marketing; network, or multi-level marketing; pyramid schemes
-
any good, service, or content that violates the law or legal rights of others

Miscellaneous
All users of the Possibilities Project Plus complying with prior written licenses may access Possibilities Project Plus thereby until authorization is terminated. Otherwise this is the exclusive and entire agreement between the Operators and you, and our actions or silence toward you or anyone else does not waive, modify, or limit the TOU or our ability to enforce them. The Disclaimer and Liability, Indemnity, Jurisdiction and Privacy Policy sections will survive termination of these TOU, and you will remain bound by those sections. If a TOU term is unenforceable, it shall be limited to the least extent possible and supplemented with a valid provision that best embodies the intent of the parties. Privacy Policy
This policy details how data about you is used when you access the Possibilities Project Plus website and Services or interact with us. We do not share your data with third parties for marketing purposes. We do not employ tracking devices for marketing purposes, however we employ tracking devices for research analytics and site improvement. We may be required to disclose data in response to a subpoena, search warrant, court order, or other legal process, or to protect our rights, property, or safety, or that of users of Possibilities Project Plus or the general public.
Data may also be used for research purposes in aggregate/summary form, where it cannot reasonably be used to identify you.
